Sued for Auto Accident Above Insurance Limit in NJ?

One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

Here is my question: Me and my wife currently have health insurance (Carrier A). Effective 6/1 I plan to get into different health insurance plan with different insurer (Carrier B). On 5/23 my son was born and as per Carrier A, I have 31 days to enroll him under my current health insurance. Since I am changing eff 6/1, will he still be covered with my current plan (even I don't add him) until I add him to the new plan? So I was recently given a citation during a trip to Northern California. Here's the condensed version; I went out with a group of friends to have dinner and drinks. It was about 10 people altogether, three car loads. I was originally not one of the drivers (I flew in from Southern California). Several of my friends/acquiantances drank heavily during dinner. I was asked as a favor to drive one of the car and the car owner's home. The car I drove belonged to my good friend's neighbor. I work 2 part time jobs and neither offer health insurance, so in 2014 I will have to buy some. One comparable to the one I had when I worked a full time job would cost $600 a month but would cover prescriptions with a $20 copay for generics with a $1500 deductible and a $4500 out of pocket maximum. That is out of what I can afford. The one I can afford is only $219 a month but has a $7500 deductible which would have to be met for any benefits and there is a $12,500 out of pocket maximum. If I got very sick I would be wiped out with that one, so it seems that I am in a Catch 22. I don't make that much money ($8 and $10 for the 2 jobs where I work 24 and 18 hours a week respectively.) Now I just pay the doctor out of pocket and I paid $375 this year for office visits and $150 for medicine. That was affordable and now I am forced to pay a premium in addition to the same amounts I paid for the same service. This thing is making me nervous. Affordable to me is no insurance. Give me a cyanide pill if I get a terminal diagnosis because being in the hospital and wiped out financially is not a good quality of life.

For this reason we are doing something very basic to keep a policy in place. This seems really strange to me and raises a question why do I have to have car insurance if I do not have a car? Why should I get a surcharge when I do get a car at a later date? This almost seems like once you're in the auto insurance system, you cannot get out without penalties. Seems a lot like the insurance industry is trying to get everyone to pay into the system with or without a car. And if that's the case this sounds awfully like the auto insurance industry has already set precedent on the health insurance industry. What am I missing?

Let's say for the sake of argument that my car is valued at 2000.00 at the beginning of this year and my full coverage insurance on this vehicle is 500.00 a year. Now at the end of this year my car has depreciated to 1500.00. Shouldn't my full coverage insurance rate be adjusted to reflect the book value of the car and lowered appropriately and be dropped to say 400.00 a year? Hello all, I am currently 16, and i have my drivers license. I am on my parents plan and i pay about $100 a month for full coverage with my parents cars. But here is my real question, I have been saving for a while (5 years) and i have enough to buy a car i have dreamed of buying for a long time. So i am going to, but my question is what would my insurence be if i did? the car is a 2002 BMW M3 SMG. It has 76,200 Miles on it. I am paying $20,000 for it. Almost five years ago I got my license suspended in Ohio for a wreckless endangerment. As soon as it got suspended I did the classes I was required to take and paid my court fees. It took me a few years to pay all of my fines and the only thing keeping my license from being re-instated was the need for SR22 insurance. I never got the insurance. I'm now in California and looking to get my license back and I heard somewhere that three years after the suspension the need for the SR 22 bond drops, but I'm not sure if that's true or not? But somebody said you need fully comprehensive insurance to be able to get a car on finance, i had forgotten about insurance. I saw an orthopedic specialist this morning who set my fracture (ideally I should have come in immediately after the incident and had it set then), after which they took another set of x-rays to check if the setting worked. The prognosis is good. I didn't pay a cent in all this, as I'm covered under the University Health Insurance Plan, which all international students in Ontario get, as the Ontario Health Insurance Plan only covers residents, anything under OHIP is covered with UHIP. I'm curious, what would the cost have been had this happened in the US, with and without insurance? Thank You

Has anyone any idea what to do or any ideas? i know I could just change insurers however it would be easier and cheaper to stay with who i'm with and I was never told when I took the policy that if my husband passed his test this one would be void..........and this is more principle as I dont like being hadover, I am going to phone and kick off tomorrow, but want to know if anyone has any solid rules and regs on this. I totaled my month old car with only liability insurance, do I still HAVE to pay off the car?

i just got a '01 explorer from a dealer less than a month ago, two days ago i rolled it, now its totaled. i only have LIABILITY insurance, and the insurance company said i have to pay off the rest of the car, which i expected, but when i called the dealer she said she might be able to count the car as a total loss, and get me in another car from them, without paying for the old one anymore. she is going to let me know in a couple days if they can. is this possible to just somehow avoid all the payments on the old car and start over new? are they scared i would end up not paying them for a car i dont have, so they somehow write it off and start a new payment plan on a whole new car? Will they try to get me in a new car and pile on my old car payments with new ones? when they call back should i act like i wont pay on that car to persuade them to write that totaled car off ? i dont know what to do, i cant afford two car payments and now im carless bumming rides which i cant do for long. Alright Y!A? :) Right, so I'm 17 and I'll probably be doing my driving test pretty soon because I'm far into lessons and I've passed my theory test already. (UK - Northern Ireland, Belfast) I'm just wondering what tips you guys out there have maybe from first hand experience or what your friends, siblings or general family have done etc. I'm getting around 3200 in the June when I turned 18 because of a car crash I was in when I was like 9 so I'm hoping to get a car + a year's insurance for around 2500 at the maximum. (Hopefully) I'll probably get a car of a maximum price of about 1000 because in reality I don't need anything fancier than that, the max engine size I'd consider would probably be 1.2 and I'd want my insurance to be such that I can use the car for work such as delivering pizzas or chineses etc. so I have more options trying to find a job atm. I'm just wondering what tips you people have? Could I realistically get insurance for 1500 (Max) or under on a 1000 (Max) car with a 1.2 (Max) Litre engine? I might have to borrow money off my parents and pay them back when I'm 18 if I pass a good few months before my birthday. I'm not coming here telling you to tell me where to get cheap car insurance, I hate questions like that lol cheap car insurance doesn't exist for 17 year olds because we're all boy racers Bla-bla-bla, it's head melting! As I'm MTF (Male-to-female) Transsexual, have been on hormones for several years and will probably go for SRS (sex reassignment surgery) in the future, I could easily get a letter stating that my predominant gender is female. I was rear ended in a 3 car crash, I am the first one. Car 2 hit me first ( I feel 2 impact), then car 3 slightly bump the car 2. The accident happened on a roundabout I was already on, someone pulled out on me and I T-boned the side of their car. Audatex is not kelly blue book they look at craigslist & not the dealer. Craigslist sometimes has cars where a mechanic might not catch it but is damaged. I've only been in one accident my entire life of driving and it wasn't my fault, a WOMAN backed into me as I was passing a parking lot. Apparently that wasn't the first time she did that either. One other time a WOMAN almost crashed into me on the free way, she wanted to get into my lane but apparently she didn't see me and just without using a turn signal just decided to turn into my lane and luckily i was paying attention and was able to break soon enough and she probably came within inches of her back side smashing into my side. it caused me to break suddenly which made the car behind me break suddenly and honk his horn, i honked my horn and the lady in front of me was apparently clueless to the world. Anyways the reason if this is true because I don't believe it men might have more accidents is because they're more likely to become drunk. Men drink and drive more, not only that but they probably like to show off more. rates should be higher for people like them, not all men. Gender biases are unconstitutional because that's prejudice. Also it's a total lie that women make less money than men. when i waited tables, the women got all the good tips from men. while i generally just got the minimum tip. not only that but sometimes if i was dealing with another male, sometimes they didn't give me a tip at all especially if they were drunk or some scruffy looking truck driver trying to hit on the other girls. But if one of those hot girls waited on them, they would sometimes give them a tip that was more than the food that they ordered! I think it's all bs. and of course completely racist. Why does america allow this? You know in some countries they don't allow women to drive. MAYBE it's because they're bad drivers!!!

Last year around September I made the grave mistake of letting a friend borrow my car to see his girlfriend and he claimed to have just gotten his license and it was supposed to come in the mail within the next week. And because he didn't have a license, they impounded my car for 30 days, but if he had gotten his license within that time, I could've retrieved my car earlier, but he was not cooperating. He now wants proof of insurance to dismiss the ticket but I'm not giving him it until I'm reimbursed for the impound fees. Is there any way to get my health insurance to cover the cost of a body lift?

6'1 , 25 y/o male, spent the majority of the past 4 years dropping from 430lbs to a current 198lbs. The weight loss has left me with large amounts of sagging skin on my inner thighs, pelvis, abdomen, chest and upper arms. All of these areas are covered in large amounts of stretch marks as well, which leads me to believe these areas will never recover without surgery. Now my chest and arms are not nearly as big of an issue as working out at the gym has started to fill these areas in with muscle, but no amount of situps are tightening the skin around my abdomen, and no amount of leg exercises are firming up my inner thighs. Cardio actually seeems to make the issue worse as I lose even more weight. I've also begun to notice that the more the skin sags around my torso, the more my lower back hurts. Also, chafing on my inner thighs and buttocks makes cardio pardon the pun, but a pain in the ***. I know insurance companies don't like to cover cosmetic surgeries but there has to be something that can be done.Any ideas?

I can't understand this issue. I have been living in the uk since 2008. I used to pay 900 for the insurance, then it raised to 1200 and now they ask me for 2300 for the third year renewal. I signed up for a motorcycle MSF class to get my license and to get experience riding a bike. I plan on getting a 250cc bike because I think it's what suits my needs and desires of what I want out of a motorcycle. She also told me my maxillofacial specialist told her at the most it should have been $3000 total or $1200 for each side. Why does insurance pay for the surgery to correct TMJ disorders but not the MRI to diagnose it? My 17 year old daughter is currently on my automobile insurance policy. She drives my car at times. She'll be 18 next February. Sometime this year, I wanted to get a new car and give her this one. I had a minor car accident in a Costco parking lot last weekend. I was backing out my parking lot; the other guy was also backing out. Unfortunately, we didn't see each other... Anyway, this seems to be a 50-50 accident. The damage to the cars are moderate and we agreed on just fixing ourselves. So no personal information was exchanged. I got an estimate today. The cost for fixing my car is not cheap but still lower than the minimal requirement for accident reporting in California. It is also lower than my insurance deductible. So I plan neither to report to DMV nor to file a claim. But one friend of mine suggested that in this case, I should still notify (but not to file a claim to) my insurance company. His argument is that the other party can still come back and sue me (if he is a freak). While we didn't exchange information, the other party may have remembered my license plate number so theoretically he could find out all other information about me. But I am not sure if notifying the insurance company will affect my premiums. What do you think?

Hello all, i'm looking for car insurance on gocompare.com site and if i'm taking the insurance on my own name, the price comes up at 1,200 for a 1995 Ford Fiesta LX 1.2. I am 20 years old, male and held the licence for 1 year (1 year and 6 months to be exact) and have 0 NCB. Now, here is where the 'cheap' part comes in. The 1,200 was ON me as a prosper and owner of the car. If i put my step dad as first driver (main) and me as an additional driver (second) it comes up as 1,500 for insurance. How is that possible? He has 6 years no claims and held the licence for over 20 years. Never made a claim or had accident. Now if i put my self as FIRST driver and him as SECOND driver, meaning that everything goes on me and i would be getting no claims bonus every year, i get the price at :- 750!
